1. Avaya’s extended warranty for PBX telecommunications systems and equipment, which are sold under its Definity brands;
2. Avaya’s use of Maintenance Software Permissions or Maintenance Service Permissions. (MSPs)
3. Whether Avaya charges for MSP’s on a per port basis;
4. The competition among Avaya and its competitors for servicing extended warranties for PBX telecommunications systems;
5. Whether there are restrictions placed on Avaya’s business partners; (“BusinessPartners”) for competing for Avaya business; and
6. Avaya’s competitive practices in the marketplace.
